India and Chile sign bilateral air services agreement

India and Chile sign bilateral air services agreement
The Government approved the signing of Air Services Agreement (ASA) between Government of India and the Republic of Chile was initialed during bilateral civil aviation consultations between the two countries held on 30th August, 2007 in New Delhi.

 

The essential features of the Air Services Agreement are as follows:

(i) Both countries shall have the right to designate as many airlines as they wish;

(ii) Either Party may revoke, suspend or limit the operating authorization or technical permissions of an airline designated by the other Party where;

a) Substantial ownership and effective control of that airline are not vested in the other Party, the Party’s nationals or both;

b) That airline has failed to comply with the laws and regulations referred to in Article 5 (Applications of Laws) of the Agreement; or

c) The other Party is not maintaining and administering the standards as set forth in Article 6 (Safety).

(iii) Both Parties reaffirm their obligation to each other to protect the security of civil aviation against acts of unlawful interference. Upon request, both parties shall provide each other with all necessary assistance to prevent acts of unlawful seizure of aircraft and other unlawful acts against the safety of such aircraft, of their passenger and crew.

(iv) Airlines are free to decide the prices for air services based on the commercial considerations in the marketplace and these prices shall not be required to be filed the aeronautical authorities of the other party.

(v) The airlines of each Party shall have the right to establish offices in the territory of the other Party for the promotion and sale of air services.

The new arrangement signifies an important landmark in the Civil Aviation relations between India and the Republic of Chile and will pave the way for establishment of air links between the two countries.

The Agreement will be signed on behalf of the two countries after it has been approved by the respective Governments. Implementation would be watched and reported by this Ministry.
